Radio Mirchi and 107.2 FM fights over the wordmark Radio Nasha
Radio Nasha 107.2 Fm is a Word Trademark filed under Class 38 on 22 January 2016 in Delhi through Delhi IP Office.
The Trademark was registered to Ht Media Limited
It was opposed by Radio Mirchi (Brand of HT Media) on 2nd August 2017
Radio Nasha 107.2 Fm replied to their Opposition on 29th September 2017
The matter went upto High Court wherein Radio Mirchi submitted that it had been providing an online music streaming service called "Pehla Nasha" since 2014. Radio Mirchi submitted that since the use has been prolonged, therefore it tantamount to trademark infringement.
Delhi High Court found merit in Radio Mirchi submissions against 107.2FM Nasha.
Further 107.2 also submitted that they have already been registered with same word mark in Class 41.
Following this, Division bench ordered that the status quo be maintained and they will next hear them on October 11, 2018.
Interesting case, lets see who gets the Nasha finally.
