Filing at Trademark Registrar when the company name has been changed

It is important to note that when a company changes its name from ABC Private Limited to ABCDE Private Limited, it is also required to intimate the Registrar of Trademarks for changes in the name of the company for the wordmark/ logo/ name already registered or applied for.

Procedure for effecting change of name of company into Trademark Certificate;

Correction of name of the company in the register can only be done by the authorised Signatory of the company along with the following documents;
a. Form TM 33
b. Certificate upon change in name by MCA duly signed by Director of the company
c. Altered MOA & Altered AOA duly certified by Director of the company
d. Deed of Assignment if the business structure has been changed
e. DD or Fees

Please note that TM 33 is to be used when you merely change the name of the company. Even when you change the company from Private Limited to Public Limited or vice a versa.

However, in respect request for alteration of address or principal place of business or address of home country, Form TM 34 is to be filed.

Recording of change in ownership is not covered under this article.

IN case the applicant wants to cancel the entry of Trademark, then, the same can be done in Form TM 35
